Mediation is a process whereby the mediator serves as a neutral and confidential facilitator of settlement discussions between the parties, and not as a judge who determines the outcome or instructs the parties what to settle for.<br/><br/>In the role of a facilitator, the mediator utilizes many techniques including cases analysis, risk analysis, case evaluation, and negotiation coaching. <br/>Although the parties are the sole determiner of the outcome of the mediation, the mediator must maintain an active role participating in assisting the parties in making those decisions. <br/>The mediator must continue to follow up and stay involved with the lawyers if the case did not settle on the day of mediation.
