Cases have involved owners, architects, engineers, general contractors, subcontractors, laborers, vendors, and suppliers. Issues pertaining to performance and payment matters, due to numerous reasons such as delays, architectural and engineering drawings and specifications, owners and contractors mismanagement, owners and contractors abuse, intellectual and technical understanding, insurance and bonding claim issues, contract and specification interpretations, schedules, default and other project impacts from A-Z.
Representative issues include performance, payment, mismanagement, abuse, misinterpretation of plans, specifications, change orders, delays, labor, and material charges offset balances on contracts and purchase orders, fraud and misappropriation of funds.
As a mediator and past party to many mediations, I carefully study the claims and position papers furnished by the parties, so that I will have a better understanding of the issues, goals, and objectives in resolving the dispute. Of utmost importance, it is the ability to understand the positions from the parties, separate claim issues, address pertinent facts and seek an amicable resolution for both parties. This is always faster and less expensive than a lengthy litigation battle.
